Terms of Service

Article 1 — Purpose

These Terms define the rights, obligations, and responsibilities between StreamyCam and Users regarding the use of the Service.

Article 2 — Definitions

• Service: StreamyCam mobile application and related features.
• User: Any person using the Service.
• Content: Any video, audio, stream, or data transmitted through the Service.
• Third-Party Platform: External platforms such as YouTube, Twitch, Facebook, Kick, and Instagram.

Article 3 — Publication and Revision of Terms

3.1 Availability

These Terms are accessible within the App and/or on the StreamyCam website.

3.2 Amendments

We may update these Terms at any time. Updates will be notified within the App. Continued use of the Service after an update constitutes acceptance of the revised Terms.

Article 4 — Access to Service

StreamyCam does not require account registration for general use. Some features may involve connecting to third-party platforms; authentication for those platforms is handled directly by the respective platform.

You are responsible for:

• Securing your device.
• Managing your connected platform accounts.
• All activity performed through your device.

Article 5 — Scope of License

StreamyCam grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use.

You may not:

• Copy, modify, or distribute the App.
• Reverse-engineer or attempt to extract source code.
• Use the App for unauthorized commercial purposes.

Article 6 — User Responsibilities

You are solely responsible for:

• All Content you stream.
• Compliance with applicable laws and third-party platform policies.
• Protecting your credentials, including stream keys and login details.

You must not:

• Stream illegal content or content you do not have rights to broadcast.
• Misuse the Service in any way that harms others or violates applicable law.
• Violate any applicable local, national, or international laws or regulations.

StreamyCam does not control user-generated content and does not assume responsibility for it.

Article 7 — Content and Responsibility

7.1 Ownership

You retain full ownership of all Content you create and stream through the Service.

7.2 User Responsibility

You confirm that:

• You hold all necessary rights, licenses, and consents required to stream your Content.
• Your Content does not violate any applicable laws or infringe any third-party rights.

StreamyCam bears no responsibility for Content transmitted through the Service.

7.3 Content Handling

StreamyCam does not monitor, review, or store live streams. All Content is transmitted directly to the third-party platform you select. StreamyCam acts solely as a technical transmission tool.

Article 8 — Service Provision and Limitations

8.1 Service Nature

StreamyCam acts only as a technical streaming tool. It does not host, broadcast, or store Content independently.

8.2 Service Interruptions

Streaming may fail or be interrupted due to:

• Internet or network connectivity issues.
• Device hardware or software limitations.
• Third-party platform restrictions, outages, or policy changes.

StreamyCam is not liable for failures caused by any of the above circumstances.

8.3 Local Data Storage

Stream configuration data (such as stream keys) may be stored locally on your device. StreamyCam does not store this data on its own servers. You are solely responsible for securing your device and any locally stored configuration data.

Article 9 — Paid Services, Subscriptions, and Charges

9.1 Payments

The App may include:

• Advertisements displayed within the App.
• Optional subscriptions offering premium features, processed via app stores (Google Play or Apple App Store).

All payments are handled by the respective app store and are subject to their payment policies.

9.2 Subscription Terms

Subscriptions automatically renew at the end of each billing period unless you cancel through your app store account settings at least 24 hours before the renewal date.

9.3 Charges

You are solely responsible for:

• Internet and mobile data usage incurred while using the Service.
• Any network or roaming charges imposed by your carrier.

Article 10 — Third-Party Services and APIs

10.1 Third-Party Platforms

The Service integrates with third-party platforms including Google services, YouTube, Twitch, Facebook, Kick, and Instagram. By connecting to any such platform, you agree to its respective Terms of Service and Privacy Policy.

StreamyCam is not responsible for:

• The availability or uptime of third-party platforms.
• Account bans or suspensions imposed by those platforms.
• Content removal by those platforms.

10.2 YouTube API Services

StreamyCam uses YouTube API Services. By connecting your YouTube account, you agree to YouTube's Terms of Service (youtube.com/t/terms) and Google's Privacy Policy (policies.google.com/privacy). You may revoke StreamyCam's access to your YouTube account at any time via Google Security Settings at security.google.com/settings/security/permissions.

10.3 Streaming Protocol Usage

The Service supports RTMP, RTSP, and SRT streaming protocols. You acknowledge that:

• These protocols rely on external servers and infrastructure not controlled by StreamyCam.
• You are responsible for configuring your own stream destinations and server addresses.

StreamyCam is not responsible for:

• Invalid or expired stream keys entered by the User.
• Errors or failures on the destination server side.
• Platform-side issues beyond StreamyCam's control.

10.4 Platform Compliance

You are solely responsible for complying with all policies of the third-party platforms you stream to. StreamyCam is not liable for API restrictions, account bans, or policy violations resulting from your use of those platforms.

Article 11 — Advertisements

The App may display third-party advertisements. Ads are not based on personally identifiable user profiles but may use contextual or device-level data. StreamyCam does not endorse the products or services advertised by third parties.

Article 12 — Service Modification

StreamyCam reserves the right to modify, suspend, or discontinue the Service or any part of it at any time, with or without notice, at its sole discretion. StreamyCam shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Article 13 — Termination

StreamyCam may restrict or terminate your access to the Service at any time if misuse or violations of these Terms are detected.

You may stop using the Service at any time by uninstalling the App from your device. Termination does not affect any obligations incurred prior to termination.

Article 14 — Errors and Inaccuracies

The Service may occasionally contain errors or inaccuracies. StreamyCam reserves the right to correct any such errors at any time without prior notice and is not obligated to update information on any particular schedule.

You agree to defend, indemnify, and hold harmless StreamyCam Inc. and its officers, directors, employees, and agents from any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service.
• The Content you stream or transmit.
• Your violation of these Terms or any applicable law.
• Your infringement of any third-party rights.

Article 18 — Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be amended to the minimum extent necessary to make it enforceable, or severed if amendment is not possible. The remaining provisions shall continue in full force and effect.

Article 19 — Entire Agreement

These Terms, together with any policies incorporated by reference, constitute the entire agreement between you and StreamyCam concerning the Service. They supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written. StreamyCam's failure to enforce any right or provision does not constitute a waiver of that right.

Article 20 — Governing Law

These Terms are governed by and construed in accordance with applicable laws in your jurisdiction. For any dispute arising out of or relating to these Terms, you and StreamyCam agree to submit to the jurisdiction of competent courts, subject to any mandatory local consumer protection laws that may apply to you.
